These Terms of Service (the “Terms”) are a binding agreement between you and Luxiac Inc. (“EngBot,” “we,” “us”), a company headquartered in Toronto, Ontario, Canada, governing your use of EngBot Academy at academy.engbot.app (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. Nothing in these Terms limits mandatory consumer rights you hold under the law of your place of residence — including Ontario’s Consumer Protection Act, Quebec’s Consumer Protection Act, and EU/UK consumer law — and where these Terms conflict with such rights, your rights win.
You must be at least 13 years old to use the Service (or the higher minimum age of digital consent where you live). If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases.
EngBot Academy is an educational product: short daily lessons, quizzes, adaptive difficulty, progress mechanics, an arcade of practice games, and optional courses generated from materials you upload. Portions of the content are generated or assembled with the assistance of artificial-intelligence systems. While we ground generation in reviewed reference material and take accuracy seriously, we do not warrant that any lesson, formula, answer key, diagram, or explanation is complete, current, or error-free — verify anything you intend to rely on.
The Service is not professional engineering advice. Nothing in the Service constitutes, or substitutes for, the services of a licensed professional engineer, and no content may be relied upon for the design, analysis, construction, operation, or certification of any real-world system, structure, product, or process. “Certifications” issued by the Service are informal records of course completion only; they are not accredited credentials, professional licenses, continuing-education credit, or endorsements by any engineering body, and must not be represented as such.
In-app items and meters — torque, bolts, streaks, freezes, buddy XP, arcade scores, and chests — are gameplay features with no monetary value. They cannot be purchased separately, sold, transferred, or redeemed for anything outside the Service, and we may rebalance them as the Service evolves. They are not property.
You are responsible for your account, for keeping your credentials secure, and for all activity under it. Provide accurate information and keep it current. If you enable email two-factor authentication, keeping access to your email inbox is part of keeping access to your account; if you are locked out, contact support at engbot.app@gmail.com and be prepared to verify your identity. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms (see section 13). You may delete your account at any time from Settings → Data & privacy; sign-in is blocked immediately and the deletion becomes permanent after the 30-day recovery window described in section 4.
You may upload course materials such as textbook excerpts or lecture slides (“User Content”). You retain all ownership of your User Content. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, process, transform, and display your User Content solely to operate the Service for you — including parsing it, sending excerpts to our AI providers to generate paraphrased lessons and quiz questions from it, and caching those outputs for your account. This licence ends when you delete the material or your account, except for backups purged on our normal cycle. We do not use your User Content to provide courses to other users, sell it, or use it to train our own or any third party’s foundation models.
You are solely responsible for having the right to upload what you upload. Uploading materials you have lawful access to for personal study — your own notes, or legitimately obtained textbooks processed into paraphrased study aids for your private use — is the intended use. Do not upload content that infringes others’ rights, and do not redistribute generated outputs in ways that would infringe the source material’s copyright. We respond to credible infringement notices under applicable law (including Canada’s notice-and-notice regime and the DMCA for U.S. claimants) sent to engbot.app@gmail.com, and may remove content and suspend repeat infringers.
To the extent we hold rights in AI-generated lessons, questions, and diagrams shown to you, we licence them to you for personal, non-commercial study. AI output can be wrong, outdated, or incomplete despite our grounding measures; it is provided for learning, and you are responsible for how you use it (see section 2). If you spot an error, we genuinely want to hear about it at engbot.app@gmail.com.
You agree not to:
We may investigate violations and take appropriate action, including removing content, resetting falsified records, suspending accounts, and reporting to authorities where required.
We send service emails (welcome, security codes, password resets, billing notices) as part of operating your account. Optional study reminders, streak alerts, inactivity nudges, weekly progress reports and product updates — by email and, in the mobile apps if you allow notifications, as push notifications — can be switched off at any time: every optional email has a one-click unsubscribe link, and Settings → Notifications on the website and in the apps switches reminders and alerts off, consistent with Canada’s Anti-Spam Legislation. The timing and wording of reminders are chosen automatically from your own activity, as described in the Privacy Policy. Reminders are a convenience: we don’t guarantee that any email or notification is delivered or arrives at a particular time, and a missed reminder doesn’t change how streaks, freezes or anything else in the Service works. Details are in the Privacy Policy.
The Service — including its software, design, the EngBot name and wordmark, the Field Crew characters and artwork, curriculum structure, and all content we or our licensors created — is protected by intellectual-property law and belongs to us or our licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose, and no other rights. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.
The Service is built on third-party infrastructure and processors — Google Firebase, Vercel, Stripe, Apple App Store and Google Play billing, RevenueCat, Anthropic, Google, Higgsfield, GitHub, and Resend — each governed by its own terms where you interact with it directly (for example Stripe’s checkout). We are not responsible for third-party services we do not control, and links to external sites are provided for convenience only.
If you use the Service through a mobile application distributed via the Apple App Store or Google Play, these Terms apply to that app too, plus the store’s own usage rules. The app licence is granted by us, not by Apple or Google; Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing any claim relating to it (including product-liability, regulatory, or IP claims). Apple and its subsidiaries are third-party beneficiaries of these Terms for apps obtained from the App Store and may enforce them against you. You represent that you are not located in an embargoed territory and are not on a restricted-parties list. If you use the mobile app as a guest, your progress is stored under a guest account tied to that installation; it cannot be recovered if you delete the app, sign out, or lose the device before adding an email to the account — the app reminds you of this, and section 4 explains guest accounts.
Our collection and use of personal information is described in the Privacy Policy, which forms part of these Terms.
We work to keep the Service available but do not promise uninterrupted or error-free operation; maintenance, updates, and factors beyond our control can cause downtime. We may add, change, or retire features (including labelling some as beta or experimental, which may change or vanish without notice). We will not materially reduce what an active paid subscription includes during a paid period without notice and a right to cancel for a pro-rated refund of the unused portion.
You may stop using the Service, or delete your account, at any time. We may suspend or terminate your access — with notice where practicable — if you materially breach these Terms, create risk or legal exposure for us or other users, or where required by law. If we terminate without cause, we will refund the pro-rated unused portion of any paid period. Sections that by their nature survive termination (including 2, 5, 6, 9, and 14–18) survive.
Except for the express commitments in these Terms and to the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will meet your requirements. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you; statutory guarantees for consumers remain in force where the law provides them.
To the maximum extent permitted by law: (a) neither we nor our directors, employees, or suppliers are liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising out of or relating to the Service; and (b) our total aggregate liability for all claims relating to the Service is limited to the greater of CAD $100 and the amounts you paid us in the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot be limited by law, including liability for gross negligence or wilful misconduct, for death or personal injury caused by negligence, or your non-waivable consumer rights (including under Quebec law, where certain limitations in this section may not apply to consumers).
If you are using the Service as a business, you will defend and indemnify us against third-party claims arising from your User Content or your breach of these Terms. If you are a consumer, this section applies only to the extent your local law allows.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Toronto, Ontario, and the parties attorn to their jurisdiction — except that, if you are a consumer, you may always bring proceedings in the courts of your place of residence, and nothing in this section deprives you of the protection of mandatory rules of the law of that place (including Quebec consumers’ right to proceed in Quebec under Quebec law). Both parties agree to attempt good-faith informal resolution first — write to engbot.app@gmail.com with the details, and give us 30 days. Any claim must be brought within two years of when it arose, where the law permits such a limit.
We may update these Terms as the Service or the law evolves. Material changes will be announced by email or in-product notice at least 30 days before they take effect where required, with the “Last updated” date revised above. If you do not agree to a change, stop using the Service and, if you have an active subscription, cancel — continuing to use the Service after the effective date means the updated Terms apply. For Ontario and Quebec consumers, amendment notices will state the new or amended clause, the prior version, and your right to refuse the amendment and cancel without penalty, as consumer law requires.
